In this case, the petitioners are apprehending their arrest in connection with Budha Colony P.S. Case No. 16 of 2017 registered for offences under sections 406, 420, 384, 323, 506/34 of the Indian Penal Code.
The petitioners are the renters of the shop situated at Budha Colony and a complaint petition has been lodged making an allegation that the accused persons entered into the garage of the Complainant to commit criminal offence, abused, assaulted and also demanded Rs. 1 lac, in failure, be ready for consequences.
Learned counsel for the petitioners submits that the petitioners had earlier lodged a case against the landlord who

No.43452 of 2018(2) dt.20-07-2018 2/2 had asked them to vacate the shop, when they begged for three months time to locate another shop, on the next date, when they came, they found that by breaking the wall, all the articles from the shop have been taken out, when he made a complaint to the landlord, he asked that as they have not vacated the shop, this method has been used.
Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XVI at Patna in connection with Budha Colony P.S. Case No. 16 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
