JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Pakaribarawan P.S. Case No. 12 of 2015 for the offences instituted under Sections 341, 323, 324, 307 and 504 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that while the informant was going to immerse Idol of goddess Sarswati and this petitioner came and said to stop the Idol near the temple but the boys who were carrying the Idol did not stop there. They stopped the Idol going to pond. On the pretext, the petitioner took Khanti from his house and gave one Khanti on the head of the informant from which blood started to ooze from his head. It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.27338 of 2015 (2) dt.22-07-2015 2/2 petitioner has falsely been implicated in the present case. It is further submitted that from perusal of the injury report at annexure-2, it would appear that the injury sustained by the informant is simple in nature.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Pakaribarawan P.S. Case No. 12 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Nawada, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
