JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is not named in the first information report and perusal of impugned order goes to show that name of this petitioner came in course of investigation as conspirator. Learned counsel appearing for the petitioner submits that name of this petitioner came in confessional statement of coaccused Nanheshwar Thakur, who has already been granted privilege of bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.43435 of 2018 (2) dt.19-07-2018 2/2 dated 27.06.2018 passed in Cr. Misc. No. 35795 of 2018. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Punpun P.S. Case No. 376 of 2017.
