In spite of order dated 01.04.2019, case diary has not been received.

The petitioner seeks bail in a case instituted for the offences under Sections 304B, 201/34 of the Indian Penal Code. Allegation against the petitioner is of committing torture and thereafter caused death of the victim due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.1.2019 and has got no criminal antecedent. The petitioner is brother-in-law of the husband of the deceased. He is separate in mess and property from the husband of the deceased. He has got no concern with the alleged occurrence. The allegations made in the F.I.R. is denied by him.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Bagaha, West Champaran in connection with Choutarawa P.S. Case No. 273 of 2018.
