Permission is granted. Let the same be done during the course of the day.
The present petition has been filed seeking the following reliefs :- " (a) To issue a writ of mandamus or any other writ or writs, direction or directions commanding upon the respondent authorities for cancelling the licence of Public Distribution System
Patna High Court CWJC No.5356 of 2019(2) dt.20-02-2020 2/3 (P.D.S.) for running shop in Gram Panchayat Raj Belaon, Police StationBelaon, District-Kaimur issued to respondent no. 6 who does not fulfill the requisite criteria for issuance of the same as she is of different Gram Panchayat and further having a licence of P.D.s. shop in the name of her bhaisur as well.
(b) To issue P.D.s. licence to the petitioner for running shop in Gram Panchayat Raj Belaon, PS-Belaon, DistKaimur." The learned counsel for the petitioner submits that the petitioner would approach the District Magistrate, Kaimur for redressal of his aforesaid grievances by filing appropriate representation, hence the District Magistrate, Kaimur (Bhabhua) be directed to consider the same and take appropriate decision. Per contra, the learned counsel for the respondent State has filed a counter affidavit, wherein it has been stated that upon verification, no illegality has been found in the appointment of the respondent no. 6.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant liberty to the petitioner to approach the District Magistrate, Kaimur (Bhabhua) by filing appropriate representation regarding his aforesaid grievances, which is directed to be considered in a just
Patna High Court CWJC No.5356 of 2019(2) dt.20-02-2020 3/3 and legal manner and accordingly, it is directed that a reasoned and speaking order be passed expeditiously.
The present writ petition stands disposed off on the aforesaid terms.
