2. Petitioner seeks regular bail in connection with Buxar Industrial P.S. Case No. 311 of 2024 dated 29.12.2024 registered for the offences punishable under Sections 329(4), 127(2), 115(2), 109 and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. The main submissions advanced by petitioner's counsel are that the FIR itself goes to show that the informant did not see the commission of the alleged occurrence of abduction of his son and as per the FIR, he got the information of the occurrence and in fact, on the same day of the alleged occurrence a quarrel took place in between the son of this

Case No. 312 of 2024 was lodged on behalf of the petitioner's side and so far as the main allegation of causing firearm injury to the informant's son is concerned, the same is against the son of this petitioner and any specific role of this petitioner in the commission of the alleged occurrence, has not been revealed and five to six unknown persons including the petitioner and his two relatives are alleged to be involved in the alleged occurrence. It is further submitted that the petitioner has been languishing in jail since 29.12.2024 and against him, the investigation has been completed and he has not remained involved in any criminal activity in the past.

4. Learned APP for the State has opposed the prayer for bail of the petitioner.

5. Considering the aforesaid submissions and mainly taking into account the facts that in the FIR, there is no specific allegation against this petitioner and the main allegation of firing that resulted in injury to the informant's son is against the co-accused Anup Paswan, son of this petitioner and also, the fact that the investigation has been completed against the petitioner and he has fair and clean antecedent, in my opinion, it is a fit case for bail to the petitioner.
