JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Kahalgaon P.S. Case no. 570 of 2014 registered for the offence punishable under Section 395 and 397 of the Indian Penal Code. Truck, cash and mobile phone of the informant and his companions are said to have been looted on the highway by some Bolero borne criminals. They also assaulted the informant and his companions.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his conscious physical possession. There is nothing in the record to indicate his complicity in the occurrence barring confessional statement

Patna High Court Cr.Misc. No.50151 of 2017 (2) dt.17-10-2017 of accused Neeraj and he was not put on TIP. The petitioner has been languishing in custody since 9.10.2016.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-7th, Bhagalpur in connection with Kahalgaon P.S.
