The petitioner, who is in custody, seeks bail in connection with Buxar (T) P.S. Case No. 205 of 2018 registered for the offence punishable under Sections 147, 148, 149, 307, 427, 120(B) of the Indian Penal Code and Sections 25(1-B)a, 225(1)A, 26, 27, 35 Arms Act.

Informant is the Police Officer, who in his written complaint has stated that on 21.04.2018 he received an information that the accused persons are forcibly grabing the land of informant, Nathuni Yadav and they are in possession of illegal arms and trying to demolish the boundary wall of Nathuni Yadav. On receiving such information, he alongwith

Patna High Court Cr.Misc. No.45674 of 2018(2) dt.27-07-2018 2/2 other police personnel went to the place and arrested accused persons. From possession of petitioner one 3.15 regular rifle and 13 live cartridges were recovered.

It has been submitted on behalf of the petitioner that rifle seized by the police is licensed rifle and the licence is in the name of one Raju Kumar Pandey, who is close relative of petitioner. It has been further submitted that police has already submitted charge-sheet and petitioner is in custody since 24.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar, in connection with Buxar (T) P.S. Case No. 205 of 2018.
