Perused the office note, which has pointed out that this civil revision application has been filed against the order passed under Order 7 Rule 11 of the C.P.C rejecting the plaint is appealable.

In view of the aforesaid report the learned counsel for the petitioner seeks permission to withdraw this application with liberty to file appeal in accordance with law.

Patna High Court C.R. No.120 of 2016 (2) dt.28-06-2016 The prayer is allowed. The revision application is permitted to be withdrawn.

If such appeal is filed by the petitioner within four weeks from today, the pendency of this proceeding may be considered as ground for condonation of delay by the appellate authority.
