2. In the present case, the petitioner seeks bail in connection with Buxar Industrial P.S. Case No.311 of 2024, registered for the offences under Sections 329(4), 127(2), 115(2), 109, 3(5) of the B.N.S. and Section 27 of Arms Act.
3. As per the prosecution case, the petitioner and other co-accused persons dragged out the son of the informant and took him to the house of the petitioner and started assaulting him. When the informant and others came to his rescue, this petitioner opened fire from his pistol and the shot hit the victim, Harindra Bind.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been
Patna High Court CR. MISC. No.19656 of 2025(3) dt.23-07-2025 2/3 falsely implicated in this case. The present case is counter blast of Buxar Industrial P.S. Case No.312 of 2024 which has been lodged by one Kabutari Devi, wife of Virendra Paswan. Learned counsel further submits that all the injury reports of the victims show simple injuries mostly caused by hard and blunt substance except for one person which is stated to be due to firearm. But even this injury is also simple and the injury report shows no bone injury. The petitioner is having no criminal antecedent and he is in custody since 29.12.2024 and charge-sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner opened fire and shot hit the victim.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the simple nature of injuries alleged to be caused by this petitioner and also considering the clean antecedent of the petitioner along with period of custody and submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar/concerned court in connection with
Patna High Court CR. MISC. No.19656 of 2025(3) dt.23-07-2025 3/3 Buxar Industrial P.S. Case No.311 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
