The petitioner seeks bail in Sugauli P.S. Case No. 216 of 2017 registered under Section 392/34 of the Indian Penal Code.

Three motorcycle borne unknown miscreants are said to have snatched the mobile, Rs. 5000/- and other articles of the informant on the point of gun and knife.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. There is nothing in the record indicating the

No.54485 of 2017 (2) dt.14-12-2017 2/2 complicity of the petitioner in the occurrence barring the confessional statement of co-accused Mani Kumar Singh and the said co-accused is having animosity with him and due to said animosity and grudge, he has falsely named the petitioner in the occurrence. The petitioner has been languishing in custody since 04.07.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Sugauli P.S. Case No. 216 of 2017.
