JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Excise Case No.2245 of 2017 arising out of Ara Town P.S. Case No.360 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 45 litres of foreign made liquor from an open field.

The learned counsel for the petitioner submits that the petitioner has been falsely roped on disclosure made by the coaccused persons and no recovery has been effected from conscious possession of the petitioner. It is submitted that the co-accused

Patna High Court Cr.Misc. No.59666 of 2017 (2) dt.22-12-2017 2/2 persons has been granted bail by this Court. The petitioner is stated to be in custody since 13.08.2017.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 4th Additional District and Sessions Judge, Ara in connection with Excise Case No.2245 of 2017 arising out of Ara Town P.S. Case No.360 of 2017.
