The petitioner apprehends his arrest in Fulkaha P.S. case No. 185 of 2018 registered under Section 419, 420, 379, 120(B) of the IPC.

The informant alleged that when she went to Customer Service Center to withdraw the money deposited in her account by the authorities under flood relief scheme the Branch Manager handed her one account No. 35335490245 and disclosed that she had taken loan from the bank. The learned counsel for the petitioner submits that petitioner is not a bank official. The informant alleged that petitioner had taken her Adhar Card and other documents on the pretext of providing her Indira Awas. The informant suspected that petitioner might have misused the documents and

Patna High Court CR. MISC. No.16898 of 2019(2) dt.26-03-2019 2/2 fraudulently got loan in her name. It is submitted that there is no document to show that petitioner took any amount from the bank in the name of informant and on mere suspicion name of the petitioner has been dragged in the case.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Ranjan, learned Judicial Magistrate, 1st class, Araria in connection with Fulkaha P.S. case No. 185 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
