The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

8.800 liters of country made liquor is said to have been recovered from the bag of the petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. She has no concern with the seized liquor. She has been falsely implicated in the case by the personnel of the Excise Department as she refused

Patna High Court Cr.Misc. No.43602 of 2018 (2) dt.19-07-2018 to oblige them to accord vegetable at her shop free of cost. There is violation of 100 Cr.PC. She has no criminal antecedent and has been languishing in custody since 06.06.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act,Madhepura in connection with Murliganj P.S.
