JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioners are apprehending their arrest in connection with Pirpainty P.S. Case No. 104 of 2015 for the offences instituted under Sections 366, 120(B)/34 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the daughter of the informant had gone with Mithilesh Yadav and Chhotu Yadav when the informant came to know this fact he went to the house of Mithilesh Yadav to enquire into the matter, the petitioners and others assaulted the informant and said that Mithilesh Yadav abducted her daughter with in intent to marry her. It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.27885 of 2015 (2) dt.22-07-2015 2/2 victim has been recovered and her statement under Section 164 Cr. P.C. has been recorded. The same is annexure -2 to the present application. As per her 164 Cr. P.C. statement she has not named the petitioners. Whatever the allegation that has been made i.e., against Mithilesh Kumar and Chhotu Kumar.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Pirpainty P.S. Case No. 104 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur, Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
