JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Kharagpur P.S. Case No. 281 of 2019 for offences under Sections 341, 323, 324, 307, 385/34 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and there is case and counter case between the parties on account of land dispute. Considering the fact that there is specific allegation of over act against the petitioner, the Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The prayer for anticipatory is rejected.

However, in the event the petitioner surrenders before

Patna High Court CR. MISC. No.17592 of 2020(2) dt.10-07-2020 2/2 the court below and seeks regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
