JUSTICE MADHURESH PRASAD ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 302 of the Indian Penal Code and 27 of the Arms Act and subsequently Section 120(B)/34 IPC have been added.

Counsel for the petitioner submits that during course of investigation based on the statements of co-accused Istekhar@ Rahul and Shankar@Rahul, he has been roped in the instant case as he is a friend of co-accused Rahul. He further submits that there is nothing on record to incriminate the petitioner in the instant case and that co-accused Md.

Ishtekhar@Gulgul, Shankar Kumar@Rahul and Rani Devi have been granted bail in Cr. Misc. Nos. 44349 of 2016, 26506 of 2017 and 20542 of 2017 respectively. Petitioner is in jail custody since 10.07.2016.

Patna High Court Cr.Misc. No.60342 of 2017 (2) dt.20-12-2017 In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge 5th, Hajipur (Vaishali) in Town (Hazipur) P.S. Case No. 470 of 2016, G.R. No. 2653 of 2016 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
