2. The petitioner seeks regular bail in connection with Piprakothi P.S. Case No. 297 of 2019 lodged on 12.09.2019, for the offence punishable under Sections 341, 307, 326, 120(B) & 34 of the Indian Penal Code read with section 27 of the Arms Act, pending in the Court of 2nd Additional Sessions Judge, Motihari, East Champaran.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected twice vide orders dated 20.09.2022 and 31.08.2024 passed in Cr. Misc. Nos. 36051 of 2022 & 82655 of 2023 respectively. Counsel submits that the petitioner is in custody since

Patna High Court CR. MISC. No.18247 of 2025(3) dt.20-06-2025 2/3 14.07.2021 and considering his period of custody, he may be released on bail.

Learned APP for the State on the other hand opposes the prayer for bail of the petitioner and submits that the criminal antecedent of the petitioner is not clean as there are 23 cases pending against him (including the present case) and out of those 23 cases, 6 cases are registered under Section 302 of the Indian Penal Code with other sections. Counsel further submits that on previous occasion, report with regard to the stage of the trial has been called for and from the perusal of the report, it transpires that out of 8 charge-sheet witnesses, only two witnesses have been examined and 6 witnesses including the I.O & Doctor are yet to be examined.

5. In this view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

6. Speedy trial is the constitutional vision of justice. Therefore, the Superintendent of Police, Motihari, East Champaran is hereby directed to do the needful by instructing the concerned S.H.O/I.O of this case to assure the appearance of the remaining witnesses for adducing evidence within six months from the date of communication of this order in

Patna High Court CR. MISC. No.18247 of 2025(3) dt.20-06-2025 3/3 connection with Piprakothi P.S. Case No. 297 of 2019, so that trial takes place at the earliest.

7. Registry is directed to transmit a copy of this order to the Superintendent of Police, Motihari, East Champaran through fax, e-mail or any other mode forthwith. Registry is further directed to hand over a copy of this order to Learned APP for the State who shall communicate this order to the Superintendent of Police, Motihari, East Champaran at his level.
