JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Vishnupad P.S. Case No. 34 of 2015 for the offences instituted under Sections 307, 324, 341/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 30.04.2015 the informant was going to market from his house and when he reached main road, the petitioner and other accused persons came there, assaulted by Farsa and caused injury to the victim. The cause of dispute is that the petitioner had wanted to execute a sale deed in his favour from his wife with regard to property which was given to her from her father.

No.27923 of 2015 (2) dt.22-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case due to land dispute between the parties. It is further submitted that the injury sustained on the part of the victim is simple in nature. It is further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Vishnupad P.S. Case No. 34 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
