The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 325 and other Sections of the Indian Penal Code.
The informant made allegation that the petitioner assaulted him with iron rod on his leg causing fracture injury. It is submitted that the petitioner happens to be maternal brother of the informant. The petitioner is residing at his Nawasa and there is a land dispute between the parties that is why this false case has been lodged. The informant did not receive any injury. Although, the injury report is not annexed with the case diary, but the witnesses have also stated that Ashok Chaudhary got fracture injury on his leg.
Patna High Court Cr.Misc. No.28698 of 2015 (4) dt.04-01-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order.
