The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 337, 435, 504/34 of the Indian Penal Code. Prosecution case is that in the background of dispute with regard to flow of the drainage the accused persons came variously armed and assaulted the informant.

It is submitted by learned counsel for the petitioners that in the bona fide land dispute the accusation has been levelled. There is counter version of the occurrence also. The informant has not received any grievous injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal

Considering the aforesaid facts, let the above named petitioners be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Nalanda at Biharshariff, in connection with Bind P.S. Case No.51/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioners shall be confirmed by the learned court below on verification of the fact that informant's side have not received any grievous injury, but if it is found that the informant's side have received grievous injury, then the petitioners shall surrender and pray for regular bail.
