The petitioner seeks bail in a case registered for the offence punishable under Sections 147. 148, 149, 341, 323, 332, 427, 435, 436, 353, 290, 283, 188, 379 and 120 B of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act, 1984.
The petitioner along with 5000 persons had created a ruckus in the name of protest against the incident happened in Jamia Millia University. They also damaged the public property. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. There is no specific allegation against him except that he was member of the mob which had taken out a procession. The allegation levelled against the

Similarly situated co-accused, namely, Chhotu @ Anda @ Md. Jasim has been enlarged on bail by a co-ordinate Bench of this court vide order dated 03.03.2020 passed in Cr. Misc. No.13302 of 2020. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Kotwali P.S. Case No.574 of 2019.
