Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. The petitioner is in custody since 26.02.2018 on the basis of confessional statement of co-accused, Raushan Kumar @ Roshan Kumar, who has already been allowed bail by coordinate Bench of this Court passed in Criminal Miscellaneous No.5777 of 2018.

Submission is that the petitioner was never put on T.I. Parade, nor anything was recovered from his possession. Investigation of the case is already complete. Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.44284 of 2018(2) dt.24-07-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Madhepura Police Station Case No.206 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
