The petitioner seeks bail in connection with Obra P.S. Case No.39/2020, registered for the offence punishable u/s 302/34 of the IPC.

Vide order dated 29.03.2023, a report was called for, regarding the stage of trial. In compliance thereof, a report sent by learned Additional District and Sessions Judge-II, Aurangabad, dated 20.04.2023, is kept at flag 'A', whereby it is stated that five witnesses have been examined, out of which, four witnesses have supported the prosecution case and rest one material and four official witness have not been examined and to procure their attendance, summons have been issued and the time likely to be taken in conclusion of the trial is about six

Patna High Court CR. MISC. No.19488 of 2023(3) dt.26-04-2023 2/2 months, if parties co-operate.

Considering the submissions made in the report and that petitioner is the main assailant, I am not inclined to grant bail to the petitioner named above. The prayer for bail is hereby rejected.
