The petitioner is in custody since 01.06.2017 in connection with a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the main culprit who had tampered with the motorcycle succeeded in escaping whereas the petitioner was arrested on mere suspicion. Though the recovery has been made which is not from the conscious possession of the petitioner and in view of the fact that the petitioner has no criminal antecedent, he may be extended the privilege of bail.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail
