The petitioner is in custody since 19.08.2017 in connection with Harsidhi P.S. Case No. 318 of 2017 for the offence registered under Sections 457, 380 of the Indian Penal Code, 1860, (IPC), added Section 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has not named in the first information report but subsequently, in the confessional statement made before the police by co-accused persons, namely, Shivam Kumar and Chutan Kumar, the name of the petitioner has come into the case. It is further submitted that in the said confessional statement, it has been stated that the stolen articles were sold to one Madan Sah, the husband of the petitioner for a sum of Rs. 400/- and thereafter, the same was recovered from the house of the petitioner. It is further submitted that the petitioner has not been put on T.I.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 318 of 2017.
