The petitioner is in custody since 19.04.2018 on his remand in connection with Sherghatti (Dobhi) P.S. Case No. 147 of 2018 for the offence registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the first information report but subsequently, on the basis of the confessional statement made before the police by the co-accused persons petitioner's name has surfaced, which has no evidentiary value. It is further submitted neither any recovery from the conscious possession of the petitioner has been made nor he has been placed on T.I. Parade.
