1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 363, 365, 323, 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that son of the informant was in love with daughter of one Dular Yadav and later, the son of the informant solemnized his marriage with the daughter of Dular Yadav, but the informant objected the said marriage and instituted a Complaint Case based on which, the instant F.I.R. came to

Patna High Court CR. MISC. No.23340 of 2024(2) dt.01-05-2024 2/3 be instituted. It is further submitted that in sum and substance, the informant alleges that his son was kidnapped by the accused persons including the petitioner.

The learned counsel for the petitioner submits that the date of occurrence is 10.12.2021 and the complaint case came to be instituted on 20.12.2021 i.e. after a delay of more than nine days without any plausible explanation. It is further submitted that petitioner is not related to Dular Yadav and Dular Yadav has been granted the privilege of anticipatory bail by a learned Coordinate Bench by an order dated 28.09.2022 in Cr. Misc. 35565 of 2022 and thus, on parity the learned counsel for the petitioner seeks anticipatory bail.

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum

Patna High Court CR. MISC. No.23340 of 2024(2) dt.01-05-2024 3/3 of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S. P. Singh, the learned Judicial Magistrate, 1st Class, Saharsa in connection with Saur Bazar P. S. Case No.38 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
