Petitioner, already in custody, seeks bail in connection with Muffasil P.S. Case No.37 of 2018 registered under Sections 399, 402, 413, 414 and 34 of the Indian Penal Code as well as under Sections 25(1-b)a/26/35 of the Arms Act. Allegation in brief is that some criminal elements were apprehended by the police while making plan for committing dacoity and arms were recovered from possession of some of them including recovery of country made pistol and one cartridge from the petitioner's possession.

Learned counsel for the petitioner submits that the petitioner has been in custody for last four months and he has no criminal antecedent.

No.42357 of 2018(2) dt.13-07-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Irshad Ansari is directed to be released on bail after framing of the charge on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Muffasil P.S. Case No.37 of 2018.
