While it is stated by Mr. Ranjeet Kumar Pandey appearing for the Patna Municipal Corporation that despite the liberty granted to the petitioner to intervene in Vigilance Case No. 85B of 2000, no such formal application has been filed, Mr. Ranjan Kumar Jha supporting the claim of the petitioner could not bring to the notice of this Court to any such application being filed by the petitioner.

The only complaint filed by the petitioner in this application is the delay in disposal of the vigilance case. Under the order of this Court an affidavit has been filed wherein in paragraph-4 it is submitted by the Municipal Commissioner that

Patna High Court CWJC No.14909 of 2014 (4) dt.30-11-2015 he intends to dispose of the Vigilance Case within maximum period of three months.

In the circumstances so discussed where except for representations there is no formal intervention application on record and that it is stated by the Corporation that on the date fixed in the case i.e. 28.11.2015 neither the petitioner nor his counsel was present rather an attendance was filed by one Sushil Kumar Jha on behalf of the petitioner, I am not persuaded to keep this proceeding pending which is accordingly disposed of.
