JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Nabinagar P.S. Case No. 21 of 2019, dated 18.01.2019, instituted for the offences under Sections 341, 323, 307 and 379/34 of the Indian Penal Code.
The petitioner is only alleged to have taken away Rs. 25,000/- from the possession of the informant. The learned counsel for the petitioner has
Patna High Court CR. MISC. No.17867 of 2019(2) dt.29-03-2019 2/2 submitted that the implication of the petitioner is because of an earlier case pending between the parties vide Nabinagar P.S. Case No. 353 of 2018. Even otherwise, it has been submitted, the informant has received only simple injury which is said to have been authored by a co-accused, namely, Guddu Kumar.
Considering the nature of accusation against the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S.
