The petitioners apprehend their arrest in connection with Majhauliya P.S. Case No.468 of 2021 registered for offences under Sections 304, 201 and 34 of the Indian Penal Code.

This anticipatory bail application is being preferred on the ground that it is a case under Section 304 of the IPC and the parties have entered into compromise.

Considered the submissions of the petitioners that they are not involved in fencing the wire in the agricultural field

In view of the fact that the parties have entered into compromise, this application for anticipatory bail is allowed. Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No.468 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. At the time of accepting the bail bond of the petitioners, the court below will verify the truthfulness of the compromise and if it is found that the parties have entered into compromise, their bail bonds shall be accepted. If the factum of compromise is denied by the informant then the petitioners shall be taken into custody forthwith.
