The petitioner seeks bail in a case registered for the offence under Section 30(a) and 32 of Bihar Prohibition and Excise Act.

180 ml. of foreign liquor has been recovered from Tiago car, of which, this petitioner was one of the occupant. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said car. Petitioner claims clean antecedent and he is in custody since 10.01.2022. Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent

Patna High Court CR. MISC. No.18474 of 2022(2) dt.26-05-2022 2/2 and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge Vth, Banka in connection with Excise Complaint Case No. 10 of 2022.
