Petitioner seeks bail in a case registered for the offences punishable under Sections 399,401,414 of the Indian Penal Code and 25(1-b)a, 26,35 of Arms Act. Name of the petitioner surfaced in the confessional statement of co-accused Mantu Rai. Submission is that though a motorcycle was recovered from the house of the petitioner, however, the same was purchased motorcycle of the father of the petitioner and it goes released by the court in favour of father of the petitioner vide Annexure-3. Some other co-accused have been allowed bail by different Coordinate Benches of this Court vide Annexure-2 series.

No.44699 of 2018 (2) dt.31-07-2018 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chapra Town Police Station Case No.465 of 2016, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
