JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2023 Heard Ms. Usha Kumari Singh, learned counsel appearing on behalf of the petitioner and Mr. Dilip Kumar No. 1, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in connection with Complaint Case Case No. 3271(c) of 2018 registered under Section 498(A) of the Indian Penal Code.
3. In spite of efforts taken by learned Mediator, Mediation has failed. The parties have not arrived at any settlement.
5. Considering the aforesaid development and taking into the desire of the Opposite Party No. 2 who is ready for one time settlement as informed by the learned counsel for the Opposite Party No.2, the petitioner is directed to surrender
Patna High Court CR. MISC. No.18681 of 2020(4) dt.24-04-2023 2/2 before the learned Court below and seek regular bail along with a joint affidavit that he is willing to enter into one time settlement with Opposite Party No. 2. If such settlement agreement is filed within two weeks, the petitioner is directed to be released provisionally with a condition that he will discharge the agreed terms within three months then in that case the provisional bail of the petitioner is directed to be made absolute, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
Accordingly, the present bail application stands disposed of.
