The petitioner, who is in custody, seeks bail in connection with Kasma P.S. Case No. 29 of 2016 registered for the offence punishable under Sections 147, 148, 149, 341, 386, 387, 435, 427, 353, 504, 506 of the Indian Penal Code and 27 Arms Act, 17 of C.L.A. Act.
Informant in his FIR has alleged that some miscreants set ablaze the mixture plant, JCB machine, other machinaries and raised Pro MCC Slogans.
It has been submitted on behalf of the petitioner that he has no criminal antecedent and he has not been named
Patna High Court Cr.Misc. No.46852 of 2018(2) dt.08-08-2018 2/2 in the FIR. The name of the petitioner has surfaced in this case on the basis of confession made by two co-accused. It has been further submitted that similarly situated persons have already been granted bail by a Coordinate Bench of this Court as contained in Annexure- 2 series of the petition. It has been further submitted that petitioner is in custody since 26.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kasma P.S. Case No. 29 of 2016.
