The petitioner seeks bail in Parsa Bazar P.S. Case No. 138/2015 registered under Sections 324, 326, 307 and 120 B/ 34 of the Indian Penal Code.
As per the prosecution case, the petitioner is said to have engaged the informant as daily wager for tilling the field of Dhogal Singh by his tractor and at the instance of the petitioner the driver of the tractor moved the tractor with intention to do away the life of the informant resultantly the left hand of the informant chopped off from his body.
It is submitted by learned counsel for the petitioner that no overt act has been attributed to the petitioner. He happens to be order giver. He has no concern with the aforesaid occurrence rather he has given the tractor to his driver to plough the field and

The occurrence is said of 12.08.2015 but the F.I.R. has been lodged on 08.09.2015 after inordinate delay without assigning any plausible reason. The driver of the tractor has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.5023 of 2017 vide order dated 15.03.2017. The petitioner has been languishing in custody since 22.07.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Parsa Bazar P.S. Case No.138 of 2015.
