This is the second attempt of the petitioner to approach before this Court for bail. Earlier, vide order dated 12.08.2021 passed in Cr. Misc. No. 5999 of 2021, the prayer for bail of the petitioner was rejected.
Vide order dated 05.04.2023, a report was called for from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 12.04.2023 has been sent by the learned A.D.J.-III, Jehanabad, which is at Flag 'R' to this application. In his report, the learned Judge has, inter alia, stated that the record is fixed for evidence. Out of eight chargesheeted witnesses, three witnesses have been examined till date
Patna High Court CR. MISC. No.21145 of 2023(4) dt.21-06-2023 2/2 and at present this Court is vacant since 01.03.2023. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected.
However, the learned District and Sessions Judge is directed to transfer this case to another Court or finally hear it himself and conclude the trial as expeditiously as possible preferably within a period of six months from today. With this observation and direction, this application stands disposed of.
