ANJANA MISHRA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehending their arrest in Turkaulia (Banjaria) P.S. Case No. 827 of 2015 registered for the offences punishable under Sections 436/34 of the Indian Penal Code. Learned counsel for the petitioners submits that though there is allegation against these petitioners but there is no independent witness to support the case.
Counsel appearing on behalf of the State after perusal of the case diary submits that while one independent witness has appeared before the police it appears to be hearsay witness and other witnesses are family members.

No.23938 of 2016 (3) dt.11-08-2016 2/2 Considering the aforementioned facts, admittedly, title suit between the parties is pending and these petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia (Banjaria) P.S. Case No. 827 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Kundan (Anjana Mishra, J.) U T
