JUSTICE BIRENDRA KUMAR ORAL ORDER 06-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Pakaribarawa P.S. Case No.58 of 2016, a case under Section 304B/201/34 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Nawada.

Petitioner is husband of the victim lady, who died in unnatural circumstances within three years of marriage in her matrimonial house. There is allegation of demand of dowry and torture for the same against the petitioner also soon before her death. Petitioner is in custody since 31.03.2017 and the matter is pending for prosecution evidence.

Considering the nature of allegation and the aforesaid

Patna High Court Cr.Misc. No.60780 of 2017 (4) dt.06-03-2018 P2/ facts, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same preferably within six months without allowing any long adjournment to any of the parties unnecessarily. The Superintendent of Police, Nawada, is also directed to ensure production of prosecution witnesses in connection with Pakaribarawan P.S. Case No.58 of 2016 before the learned trial Court.

Let a copy of the order be communicated to the Superintendent of Police, Nawada.
