The petitioner is languishing in custody since 18.08.2017 in connection with Chandi P.S. case no. 267 of 2017, registered under Sections 420,413 and 414/34 of the I.P.C. Three accused persons ( not the petitioner) were found engaged in selling stolen motorcycles which was/were being supplied to them by another co-accused Ravi Kant Tiwary @ Murarji Tiwary who was a serving employee in a police department. On his confessional statement some recoveries were made from different co-accused(s). One of the motorcycles was also recovered from the possession of the petitioner. It is stated that the main accused had committed fraud on him. He is a teacher and bonafide purchaser. He has no criminal antecedents. Other co-accused(s) of the present case, namely,
Patna High Court Cr.Misc. No.50844 of 2017(2) dt.09-11-2017 2/2 Ravi Kanti Tiwary and Anuj Kumar have been granted the privilege of bail by this Court in Cr. Misc. no. 50019 of 2017 and Cr. Misc. No. 46863 of 2017.
In view of the above, this Court is inclined to release the petitioner on bail. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Hilsa, Nalanda /concerned Court, in connection with Chandi P.S. Case No. 267 of 2017 corresponding to G.R.No. 1728 of 2017 subject to the condition that one of the bailors of the petitioner shall be his own/close family member.
