The petitioner seeks bail in connection with Barachatti P.S. Case No. 80 of 2013 registered under Sections 18 and 20 of the N.D.P.S. Act.

Petitioner along with twenty other accused persons are said to have been cultivating the poppy crop in the naxal hit area located at south Barachatti which was destroyed by the police.

It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather omnibus. The details of the property have not been mentioned in the F.I.R. and petitioner has no concern with the

Similarly situated several accused persons have been enlarged on anticipatory bail by the learned lower court. The petitioner has been languishing in custody since 26.08.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Gaya in connection with Barachatti P.S. Case No. 80 of 2013.
