JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 409 of the Indian Penal Code. The FIR has been lodged by the present PACCS Chairman, Kopa alleging therein that no charge of Licence No. 06/2011 of PDS by the then PACCS Chairman has been deposited due to which running of PDS shop is disturbed. It has been submitted on behalf of the petitioner that it has been alleged that no licence fee has been deposited by the petitioner. It has been further submitted that vide Annexure 2 the petitioner has deposited the said licence fee before the authority. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Patna High Court Cr.Misc. No.27168 of 2015 (2) dt.21-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Arbind, Judicial Magistrate, Saran at Chapra, in connection with Kopa P.S.Case No. 20/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
