Petitioner is in custody in connection with Bhitaha P.S. Case No. 40 of 2018 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 32.9 liters of Deshi wine was seized.

Learned counsel for the petitioner submits that the wine was seized from the motorcycle which does not belong to the petitioner.

Considering the fact that petitioner has no criminal antecedent and the petitioner is in custody since 18.12.2018, the

No.17843 of 2019(2) dt.26-03-2019 2/2 Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, West Champaran, Bettiah, in connection with Bhitaha P.S. Case No. 40 of 2018.
