2. The petitioner is in custody since 28.12.2019 in connection with Excise Case No. 444 of 2019 for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 354.600 litres of illegal wine from a vehicle. It is further submitted that he was not arrested nor any recovery has been made from his possession. The petitioner claims clean antecedents.

4. Learned APP appears and has been heard.

5. Be that as it may and having regard to the period of custody already suffered since 28.12.2019, let the petitioner

Patna High Court CR. MISC. No.16840 of 2020(2) dt.14-05-2020 2/2 above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise, Gopalganj, in connection with Excise Case No. 444 of 2019, if he is not otherwise required in any other case.
