Opposite party is in jail in connection with another case. Learned Addl. Public Prosecutor appearing for the State submits that opposite party, after being released from jail in connection with Barari P.S. Case no. 130/2010, started giving threatening to the prosecution witnesses of the aforesaid case for which Officer-in-charge of the concerned police station made a petition before the Chief Judicial Magistrate, Katihar. In my view, if there is substance in the case of the petitioner, he may raise the aforesaid point before trial court where Barari P.S. Case no. 130/2010 is pending and if the petitioner does so, the concerned court shall pass appropriate order in accordance with law.

Accordingly, this petition stands disposed of with the above stated observation.
