The petitioner is in custody since 19.07.2017 in connection with Kotwali (Tilkamanjhi) P.S. Case No. 437 of 2017 for the offence registered under Sections 457, 380, 414, 427 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is alleged to have been taken into custody in an attempt to commit theft in a house and since the lock of the house is found to be in broken condition, it was suspected that he was one of the culprits and he was taken into custody. It is further submitted that the petitioner has no criminal antecedent and has been in custody for more than four months.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.58622 of 2017 (2) dt.12-12-2017 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Thilkamanjhi) P.S. Case No. 437 of 2017.
