The petitioner seeks bail in connection with Sabour P.S. Case No. 166/2017, registered for the offences punishable under Sections 363, 366 of the Indian Penal Code.

The petitioner is said to have kidnapped the wife and two children of the informant with intention to perform marriage with his wife.

It is submitted by the learned counsel for the petitioner that the victim in her statement recorded under Section 164 Cr.P.C. herself stated that she is in love with the petitioner and as her husband assaulted her and her two children and drove her out of his house, she left her house and went along with the petitioner. She also got married with the petitioner in the year 2012. The

Patna High Court Cr.Misc. No.53764 of 2017 (2) dt.09-11-2017 2/2 petitioner has been languishing in custody since 11.09.2017. Considering the facts and circumstances of the case, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate X, Bhagalpur in connection with Sabour P.S. Case No. 166/2017.
