The petitioners are apprehending their arrest in a case registered under Sections 498(A), 304(B) read with Section 34 of the Indian Penal Code.

Allegation against the accused persons including the petitioners is of torturing and causing death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. Petitioner Nos. 1 & 2 are old mother-in-law and sister-in-law of the deceased respectively. Except for this, there

Patna High Court CR. MISC. No.21597 of 2023(2) dt.24-06-2023 2/2 is no other substantive evidence to suggest the implication of the petitioners in the present case. The husband of the deceased is in custody.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with Bhawanipur P.S. Case No. 168 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The petitioners are directed to co-operate during the trial. If the petitioners do not co-operate during the trial, the Court below will be at liberty to cancel the bail bonds of the petitioners.
