2. The petitioner apprehends his arrest in connection with Mokama P.S. Case No. 437 of 2023 registered under Sections 363, 366A and 34 of the Indian Penal Code.
3. It is alleged that the son of this petitioner kidnapped the daughter of the informant.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is an old man having aged about 62 years and he is made accused in this case only because he happens to be the father of co-accused Lallan Rai with whom the victim eloped. It is next submitted that co-accused Mukesh Rai and Aadi Rai who
Patna High Court CR. MISC. No.23463 of 2024(3) dt.15-05-2024 2/2 happens to be brother of co-accused Lallan Rai having similar allegation have already been granted bail by the impugned order itself.
5. Having considered the fact that petitioner is an old man and similarly situated co-accused persons have already been granted anticipatory bail by the Court below itself, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIII, Barh, Patna in connection with Mokama P.S. Case No. 437 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
